Biography:  Robert Clark is an Associate Professor of Law at University College, Dublin, and is a member of the Irish Bar.  He is a Consultant with Arthur Cox where he specialises in Contract, Intellectual Property and Information Technology Law. Professor Clark is the author of Data Protection Law in Ireland.

Conference topic:  Billy Hawkes will highlight the key areas of data protection legislation, and discuss compliance methods.  Also, he will outline enforcement priorities and look at current and future challenges for Irish organisations.

Biography:  Billy Hawkes was appointed by the Government as Data Protection Commissioner in July 2005 for a 5-year term.

Prior to his appointment, he worked as a civil servant in various government departments, most recently Finance, Enterprise, Trade & Employment and Foreign Affairs.

Conference topic:  Willa Mawhinney will show how data protection can effectively assist business strategy by meeting and exceeding both customer and business expectations.  Her experience at a multi-national insurance company will show how these strategies can be developed through all facets of data protection compliance, including: obtaining and storing data, ensuring data quality, managing customer consents, using data in your business, and transferring data to third-parties.

Biography:  Willa Mawhinney has been a Compliance Manager with Allianz since 2003.  She looks after data protection and all other regulatory compliance in both Ireland and Northern Ireland.  She also represents Ireland on the Allianz International Compliance Forum, which brings together compliance officers from over 70 countries worldwide.  Previously, she held a range of Marketing Management positions, most recently in Allianz, and previously with Bank of Ireland.  Therefore, she understands the vital importance of meeting the legislative requirements and the spirit of those requirements, as well as aligning these to the customer and business expectations.

Conference topic:  Rob Corbet will deal with the practicalities of handling data subject access requests.  He will consider what information must be provided and what may be retained, as well as the all-important definition of personal data, whether third-party data must be disclosed, and the law on confidential expressions of opinion.  He will also provide practical guidance on adopting a data access policy in your organisation.

Biography:  Rob Corbet is a Partner with Arthur Cox, and his practice is primarily focused on technological innovation.  He has particular experience in data protection, advising many of Ireland’s largest companies.  He is also a leading adviser in the area of sports law where he advises many significant players, both domestic and international.  Rob has been widely published on IT, IP and related matters both domestically and internationally.  He is a leading author and lecturer on technology law in the Law Society of Ireland and a regular contributor to Privacy & Data Protection Journal.

Conference topic:  Bill Moss will consider the data protection issues that arise in direct marketing campaigns.  In addition to providing invaluable tips for compliance, he will examine self regulation and the Codes of Practice, and point out specific areas of concern for direct marketers, including third-party data, opt-out choices and the National Directory Database.

Biography:  Bill Moss is the founding member, Chairman and Data Protection Specialist of the Irish Direct Marketing Association, and the Managing Director of the Bill Moss Partnership.  Previously he managed the marketing services department of Dun & Bradstreet for over 10 years.

Conference topic:  John Menton will consider the data protection implications of employee monitoring, corporate governance, obtaining and using evidence in disciplinary proceedings and unfair dismissal claims, and whistle blowing.

Biography:  John Menton is a Partner at Arthur Cox and is head of the Technology and Intellectual Property practice group.  He specialises in representing a broad range of technology companies from domestic start ups through to multinational household names.  His primary experience was gained whilst dealing with North American technology companies when they were establishing themselves in Ireland.  In addition to practicing law, John is also a keen sportsman and represented Ireland in the Discus at the Sydney Olympics in 2000.

Conference topic:  Computer evidence is increasingly useful in all kinds of legal cases and disputes.  Forensic experts can follow data trails to make valuable discoveries.  Bearing this in mind, what should you be doing in your organisation?  What information might be buried in your company or clients’ computer systems?  What data must you hold?  What data must you destroy?  What if it’s the same data?  Andrew Harbison will examine these issues, will look at some surprising and revealing real life examples and will make suggestions for creating a computer usage policy.

Biography:  Andrew Harbison leads the IT Forensics and Litigation Support practice at Deloitte, Dublin.  Previously he founded and led the IT Forensics practice at Ernst & Young.  He is perhaps the most experienced IT Forensics practitioner in private practice in Ireland.  He has provided support to companies and litigators in over 200 cases.  He has written extensively on IT Forensics, Computer Fraud and many other topics.

Conference topic:  Philip Jones will consider what records management actually means, what are the reasons for doing it, how it’s done, how it fits in the organisation, the resource implications, how to plan for the future, as well as how to manage the expectations and limitations which inevitably arise.

Biography:  Philip Jones is Head of Information Governance at Staffordshire County Council where he has corporate responsibility for records and information management, information legislation, information security and the corporate EDRM Programme.

Philip has been involved with record and document standards for over ten years and is a co-editor of ISO 15489 International Records Management Standard.

Amongst his other professional activities, Philip has served as Director and then Chairman of the Records Management Society.  He is currently President of the International Records Management Council.  Philip was voted UK Records Manager of the Year 2000.

Conference topic:  Peter Carey will discuss the barriers to the free movement of personal data and highlight the main methods to circumnavigate the European data export ban including: Consent, Model Contractual Clauses, Safe Harbor, and Binding Corporate Rules.  Peter Carey will also discuss the often forgotten issue of intra-European data transfers ( e.g. the transfer of personal data from Ireland to the United Kingdom ).

Biography:  Peter Carey is a Solicitor and Consultant to London law firm, Charles Russell, Visiting Lecturer at the College of Law and is a leading data protection expert.  Peter has written the UK's leading book on data protection and is editor of the journal, Privacy & Data Protection.  He advises on all aspects of data protection compliance, conducts data protection audits for commercial organisations and law firms and provides training courses on data protection compliance.

Biography:  Colin Rooney is an Associate in the Technology Group of Arthur Cox.  Colin advises a wide variety of clients on data protection, information management and freedom of information issues.  He has particular expertise in the education, marketing, financial services and telecommunications sectors.
