Conference topic:
Organisations are now being asked to ensure
an appropriate level of data protection
accountability. It favours managing
privacy objectives by establishing goals and
giving staff both the ability and the
responsibility to determine appropriate,
effective measures to reach those goals.
In this presentation, Billy Hawkes gives
delegates key insights into how to achieve data
protection accountability in their
organisations.
Biography: Billy Hawkes has been
the Data Protection Commissioner since 2005.
Prior to his appointment, he worked as a civil
servant in various government departments,
including Finance, Enterprise, Trade &
Employment and Foreign Affairs. In June
2010, he was reappointed to the post for another
5 years.

management and compliance requires effective and
well thought-out policies for handling personal
data. In this presentation, Johanna
provides practical guidance on creating policies
and gives tips on how best to implement them.
Biography: Johanna Pimentel is
Director of Privacy for Europe, Middle East,
Africa and South Asia for Western Union.
She is a lawyer qualified with an LLM in
Computers and Telecommunications from the
University of London and Certification of
Essential Management from Columbia Business
School. Prior to joining Western Union,
Johanna worked as Counsel for Orange, the
Dominican Telecoms Regulator and in private
practice.

The Biggest Threat
to Personal Data: The Insider
Colm Murphy

Conference topic: The largest
threat of a data breach comes from inside the
organisation: employees can be responsible for
accidental or deliberate misuse, as well as data
losses. Colm discusses the nature and
scale of insider threats, how to identify which
employees or systems pose the highest risk, and
how to implement controls that ensure valuable
data will be kept safe.
Biography: Colm Murphy, Espion’s
Technical Director, is recognised as one of
Ireland’s leading IT Security experts. He
holds a B.A. from Trinity College, and a Post
Graduate Diploma from Staffordshire University
(IT for Strategic Management). He has
worked in the ICT industry since 1996 and has
specialised in Information Security since 1998.
He has led and managed a range of information
security projects in the public and private
sectors in Ireland, the UK, Australia, New
Zealand, Malaysia, Hong Kong, Singapore, and the
Philippines. Colm was appointed an expert
evaluator by the European Commission for the
Preparatory Action on Security Research in 2007.

and Data Protection Compliance

organisations are turning to cloud computing and
similar technologies to manage their
information, since such resources are cost
effective and efficient. However cloud
computing raises some unique data protection
issues, including control and disposal of data,
and the risk of unintended data sharing. This
session addresses the issues that must be
considered when using cloud computing solutions,
including issues with data transfers, data
controller/processor status and practical steps
to ensure compliance.
Biography: Gary Comiskey is a Director
with Deloitte, specialising in data protection and
technology. He has supported several Irish and
multi-national organisations in the development of their
data protection programmes and in reviewing and
improving programmes that are already in place.
His focus is on using technology to support and maintain
effective data protection management.

Privacy
Rob Corbet

data management is maintaining a person’s right
to privacy. Rob Corbet examines the legal
basis for the right to privacy and gives
practical advice on how organisations can
respect the right to privacy when managing data
collected in the workplace as well as data
collected in public places.
Biography: Rob Corbet is a
Partner with Arthur Cox, and his practice is
primarily focused on technological innovation.
He has particular experience in data protection,
advising many of Ireland’s largest companies.
Rob has been widely published on IT, IP and
related matters both domestically and
internationally. He is a leading author
and lecturer on technology law in the Law
Society of Ireland.
Rob is the editor of the practical compliance
journal,
Data Protection Ireland.

person’s religion or ethnic origin) is already
heavily restricted by data protection law.
Recent developments mean that organisations need
to be even more careful. In this talk, Dr.
Clark provides practical guidance for using
sensitive personal data, reviews real-life case
studies and considers imminent new legislation.
Biography: Robert Clark,
Barrister, is a consultant within the Technology
and Life Sciences Practice Group of Arthur Cox.
Robert has published widely in the areas of data
protection, intellectual property law and
contract law. He has served on a number of
Government bodies, most recently the Department
of Justice Data Protection Review Group and the
Sales Law Review Group, of which he was the
Chair. A former academic, he holds the
title of Professor Emeritus, University College
Dublin. As a consultant to the Law Reform
Commission, Robert was a researcher on the
recently published consultation paper, Insurance
Contracts.

Property practice group of Arthur Cox.
Colin advises a wide variety of clients on data
protection, information management and freedom
of information issues. He has particular
expertise in the education, marketing, financial
services and telecommunications sectors.

happens. For many organisations it’s not a

incident will occur. Organisations must be
prepared. Monika reviews practical case
scenarios and shares practical tips on best
practice, from the UK, France and Germany. She
also discusses the imminent changes to Irish law
on breach notification.
Biography: Monika Kuschewsky is
a Partner at Van Bael & Bellis in Brussels.
She heads the firm’s European data protection
law practice and is qualified as a company data
protection officer. She has coordinated
and supervised pan-European data protection law
projects and audits for several multinationals
and SMEs established in Asia, Europe and the
USA. Monika develops and implements
tailormade compliance programmes and regularly
advises on questions of data protection law,
with a particular focus on international data
transfers, outsourcing and HR.

Biography: John Menton is a
Partner at Arthur Cox and is head of the Technology and
Intellectual Property practice group. He specialises in
representing a broad range of technology companies, from
domestic start-ups through to multinational household
names. His primary experience was gained whilst dealing
with North American technology companies when they were
establishing themselves in Ireland. In addition to
practising law, John is also a keen sportsman and
represented Ireland in the discus at the Sydney Olympics
in 2000.
