Data Protection Workshops

On the second day of the 5th Annual Data Protection Practical Compliance Conference, Friday 12th November 2010, delegates have the opportunity to choose two of four practical half-day Workshops covering important aspects of data protection practice.

  - Data protection workshop -   Each Workshop covers an in-depth analysis of a specific issue of data protection compliance, and will give the delegates opportunities to ask questions and discover how issues are dealt with at other organisations.
   

These Workshops can be booked separately or in conjunction with the Conference. Attendance at the Workshops by Conference delegates is optional but it is anticipated that most Conference delegates will wish to attend one or more of the Workshops. Lunch will be provided at the venue starting at 12.45pm.





Morning Sessions ( 10.00 – 12.45 ):

A: Data Protection Issues in the Workplace

Workshop led by Colin Rooney - Associate, Arthur Cox

For Human Resources departments, meeting the requirements of data protection law can be particularly challenging.  Holding and handling staff information carries significant legal responsibilities and risks.  In this Workshop, Colin gives practical guidance on meeting those challenges by looking at:

  • The application of data protection law to both employees and contractors
  • Employing new staff - how to ensure that the whole process is lawful, including candidate vetting and interviewing
  • How to ensure that monitoring in the workplace is carried out legally
  • How to develop a programme for the cost effective management of staff access requests
  • Retention of records - how long different types of staff information can be retained and when it must be destroyed

Colin Rooney is a Solicitor in the Technology and Intellectual Property practice group of Arthur Cox.  Colin advises a wide variety of clients on data protection, information management and freedom of information issues. 

He has particular expertise in the education, marketing, financial services and telecommunications sectors.

B: Training Staff in Data Protection Compliance

Workshop led by Fedelma Good - Head of Marketing Privacy and Suppression Management, Barclays

Data protection compliance is an essential legal requirement for all organisations.  All employees, regardless of their role, must understand what this means for them in the context of their daily working lives.

This Workshop provides a step-bys-step guide to putting in place an effective and sustainable data protection education programme, including:

  • Techniques and tools to guide you through the educational planning process
  • Practical advice to help you avoid the pitfalls and keep the plan on track
  • Ideas on content, format and delivery to ensure that employees understand the material and stay engaged

Workshop Leader - Biography:

Fedelma Good is Head of Marketing Privacy and Suppression Management at Barclays.  She has responsibility for oversight of the group’s compliance with privacy and data protection laws in relation to marketing activities. 

She deals with the whole life cycle of personal data - from collection, through management and its use for marketing purposes.

A graduate of Trinity College Dublin, Fedelma started her working life with the Bank of Ireland in Dublin and moved to London in 1989 to join Deloitte.  She is currently deputy chair of the UK Direct Marketing Association (DMA) and is a regular speaker on marketing, privacy and data management issues.



 

Afternoon Sessions ( 2.00 – 4.45 ):

C: Sending Personal Data Abroad

Workshop led by Peter Carey - Solicitor, Charles Russell

Organisations need to transfer data abroad for a variety of reasons.  Examples include an Ireland-based subsidiary sending staff information to its parent located abroad, using call centres or dictation services in India, using a website hosting service in the US or simply having a networked IT system where one or more offices are located abroad.

The ban on transfers of data outside Europe has been an ongoing challenge for many organisations since the 1995 Data Protection Directive was adopted.  In practice, there are a number of ways to legitimise transfers, but finding the right solution can be a difficult decision to make.  This Workshop, focuses on the various options and provides practical guidance on how to implement the right one. It includes:

  • An understanding of the data export restrictions
  • An analysis of the exemptions from the export ban contained in the Data Protection Acts 1988 and 2003
  • When the use of model contractual clauses might be the best solution
  • Why Safe Harbor might be a good option for transfers to the US
  • An analysis of the fundamentals of Binding Corporate Rules

Workshop Leader - Biography:

Peter Carey is a Solicitor who is dually qualified in both Ireland and the United Kingdom.

He is a Consultant with the London law firm Charles Russell, and is described by the British Computer Society as “one of the leading experts in European Data Protection law”.

Peter has written Europe’s leading book on data protection compliance and later in 2010 will be publishing a new book specifically for Irish organisations, Data Protection in Ireland ( Round Hall ).  He provides data protection advice to clients in the public and private sectors, including government, health care, telecoms, insurance, charities and law firms.






D: Developing Data Protection Policies

Workshop led by Tony Delaney - Assistant Commissioner, Office of the Data Protection Commissioner

Organisations should have a comprehensive policy in place to ensure that all staff understand how to use and protect personal data.  In this Workshop, Tony Delaney provides guidance on the issues which should be considered when creating a data protection policy incorporating all eight data protection principles, including:

  • How to obtain and process data fairly
  • What data may, and may not, be used for
  • How to keep data safe and secure
  • How long should data be retained
  • How to manage access requests

Workshop Leader - Biography:

Tony Delaney joined the Office of the Data Protection Commissioner in June 2006 and was appointed Assistant Commissioner with responsibility for investigations. 

He is in charge of the investigation of the caseload of complaints which the Office receives from the general public.  He also runs the Office’s prosecution functions.

Prior to his current post, he worked in several areas of the public service such as the Revenue Commissioners, Department of Agriculture, Department of Equality and Law Reform and the Department of Justice.
